Do you know the current laws applying to building property that is zoned outside town lines ?
How can one get his/her property re-zoned ?

This is a complex issue.
If the land is outside village limits the general rule is that you may build a property, with basement and two storeys, of up to 200 sq.m. in the minimum requirement 4,000 sq.m. plot.
There are exceptions: if the land is actually on the border/boundary, within a village ‘belt’, or has a particular road frontage—then the laws can be varied.
Please note that only a qualified engineer can give the ‘all-clear’ on whether a plot qualifies for a specific sized building.
We are unaware of any procedure for having a plot ‘re-zoned’.
It is not unknown for village boundaries to be revised. This may happen as a result of the building of several properties outside a village limit which are then encompassed within the village at a later date.
This is a reactive consequence whereas obtaining planning permission is pro-active. In short: it is not possible to pre-empt planning permission in lieu of future situations.
It is essential that the engineer has an excellent local knowledge. He should be aware of behind-the-scenes local policies and should advise accordingly. We have a very good engineer as part of our team. |
